GENERAL PURCHASE CONDITIONS

 

PURPOSE AND SCOPE OF APPLICATION. IDENTITY AND CONTACT INFORMATION


The purpose of these General Conditions is to regulate the relationship relating to all transactions carried out in the virtual store that customers (hereinafter, the Customers) may carry out with:

ACCEPTANCE AND ACCEPTANCE TEST

To use the purchase or subscription services on the Website, you must be of legal age. 

The purchase of the products must be made by clicking the "FORMALIZE PAYMENT" button and clicking the acceptance box for the General Conditions that appear at the bottom of the purchase order page. This indicates full acceptance of, among others, each and every one of the General Conditions, as displayed on the Website prior to the purchase of the products. Any subsequent changes to the General Conditions will not apply to you. In this case, you will be informed of any changes that may affect you. 

From the moment of acceptance, the user acquires the status of Ariane Jewels Customer, as described in these General Conditions. Any product or service subsequently offered by Ariane Jewels must be subject to a new contract. If the Customer wishes to read the General Conditions in more detail, they may print them on paper or save them electronically.  

Once these General Conditions have been expressly accepted, Ariane Jewels will send the Customer proof of the purchase, including all its terms, via email or certified mail with acknowledgment of receipt within 24 hours of the purchase. Ariane Jewels informs you that it archives the electronic documents formalizing purchases. If the Customer makes a mistake when submitting the information, they may modify it by contacting us via email. info@arianejewels.com.If the modified information refers to your postal address, which determines delivery to the post office corresponding to the address where the purchased product will be delivered, provided the product has not been shipped, the delivery will be made to the new address indicated. Otherwise, the Customer must wait for the product to be sent again.


Some products may be subject to availability. In this case, the customer will be informed and given the option to purchase a similar product, cancel the contract, or receive an alert when the product is back in stock.


PRICES, PAYMENT METHOD, DELIVERY AND WITHDRAWAL

  1. Prices

The prices applicable to each product are those indicated on the website on the date of the order, including VAT (Value Added Tax). The price of the product or subscription will be sent in the order confirmation along with these General Conditions. 

Offers will be duly marked and identified as such, appropriately indicating the previous price and the offer price. Ariane Jewels reserves the right to make any changes it deems appropriate to the website at any time and without prior notice. Products and services may be updated daily based on market trends. Shipping costs are indicated on the website.

Additionally, the price associated with shipping costs will depend on both the delivery address and the shipping method selected. The final price will appear when you select the delivery method and address. 

For orders destined for Ceuta, Melilla, and the Canary Islands, deliveries are exempt from VAT, although applicable taxes and duties may apply in accordance with the regulations in force in each of these countries:

.- Ceuta and Melilla: Tax on Production, Services and Imports (hereinafter IPSI)

- Canary Islands: Canary Islands General Indirect Tax (hereinafter, IGIC)

In the case of orders with destinations other than those mentioned above, deliveries will also be exempt from VAT, notwithstanding the application of the corresponding taxes and/or tariffs in accordance with applicable regulations. 

  1. Method of payment

Payment for any product will be made using any of the credit or debit cards indicated at the time of purchase.

Payment by credit or debit card is made through Shopify's payment gateway, which complies with PCI-DSS security measures. 

If you have trouble processing your card payment, we recommend contacting your bank to verify that your card allows for online purchases. 

If Ariane Jewels is unable to collect payment for any reason, the contract will be deemed unfinished and the purchase will not be formalized. 

  1. Delivery

Deliveries are sent to the address indicated by the Customer. Once payment has been received, Ariane Jewels will ship the product. The total shipping cost and delivery date will vary depending on the shipping address: 

Delivery times:

  • Península: 3-5 Business Days Standard Shipping, Express Shipping 2-3 Business Days
  •  Islas Baleares: 4-7 Business Days
  • Ceuta, Melilla e Islas Canarias:6-8 Business Days
  • Other countries:  8-15 Business Days

Shipping costs: 

  • Peninsula:6€ for Standard shipping, 15€ for Express shipping
  • Ceuta, Melilla, Islas Baleares and Islas Canarias: 15€
  • European Union: Orders under 150€, shipping costs 15€. Orders over 150€, shipping costs free.
  • US and UAE: Orders under 200€ receive 20€ shipping. Orders over 200€ receive free shipping.

Withdrawal

Ariane Jewels guarantees the Customer the possibility of canceling their order at any time and free of charge, provided that the cancellation is communicated before the order has been made available to the carrier for shipment. Otherwise, the Customer must wait until they receive the order to process its return. The Customer has a period of fourteen calendar days from receipt of the purchase to terminate the contract. 

This will not apply in cases of sales of objects that can be reproduced or copied immediately or that involve a personalized order. The Customer must notify Ariane Jewels within the stipulated period and by any means admitted by law, of their desire to exercise the right to terminate the contract. The returned order must be delivered together with the withdrawal form (Annex to these General Conditions), the delivery note and, where applicable, the invoice issued by Ariane Jewels through the order processing agency of their choice, with the Customer bearing the shipping costs necessary to make the return. The Customer may return any item* that they have purchased from Ariane Jewels as long as the products have not been opened or used and retain their seal or original packaging. (* Earrings may only be exchanged and not returned, nor may personalized products or products indicated as FINAL SALE.)For rings marked with a Stone seal, only exchanges will be accepted, not returns. If a different product than the one ordered by the customer is delivered due to an error by Ariane Jewels, the correct product will be delivered, and the original product will be collected at no additional charge to the customer. If a product arrives broken, damaged, or in poor condition, Ariane Jewels will collect it from the customer's home and replace it with another in good condition at no additional charge.

LANGUAGE

The language in which the contract between Ariane Jewels and the Client will be concluded is Spanish.


ARIANE JEWELS RESPONSIBILITIES

Ariane Jewels guarantees the quality of the service contracted through the Website. All rights granted to consumers and users by current laws are guaranteed. Failure to comply with any of these General Conditions may result in the return of the products or the cancellation of the Services purchased by the Customer.


CUSTOMER RESPONSIBILITIES

The Client agrees to use the Services lawfully, without violating current legislation or harming the rights and interests of third parties. The Client guarantees the truthfulness and accuracy of the data provided when completing the contracting forms, avoiding any damages to Ariane Jewels resulting from any incorrect information. Failure to comply with any of these Terms may result in the withdrawal or cancellation of the Services by Ariane Jewels without prior notice to the Client and without entitling the Client to any compensation.


INDUSTRIAL AND INTELLECTUAL PROPERTY

The intellectual and industrial property rights over the works, trademarks, logos, and any other protected rights contained on the Ariane Jewels website belong exclusively to Ariane Jewels or to third parties that have authorized their inclusion on the website. The unauthorized reproduction, distribution, commercialization, or transformation of such works, trademarks, logos, etc. constitutes an infringement of the intellectual and industrial property rights of Ariane Jewels or their owner, and may give rise to any judicial or extrajudicial actions that may apply to them in the exercise of their rights. Likewise, the information that the Client can access through the website may be protected by industrial, intellectual, or other property rights. Ariane Jewels shall not be liable under any circumstances or circumstances for any infringements of such rights that may be committed by the User.


WARRANTY

Ariane Jewels will be liable to the Customer for any lack of conformity in deliveries within two years, as established by current regulations. Any damage caused by use or improper use, as well as any other damage excluded by current legislation, are excluded from the warranty provided. Gold plating on jewelry is excluded from the warranty. Ariane Jewels already announces that the plating is not eternal and that its durability will depend on the proper use of the piece and the pH of each person.


JURISDICTION AND APPLICABLE LAW

The relationship between Ariane Jewels and the Client shall be governed by current Spanish law, and any dispute shall be submitted to the Courts and Tribunals of the city of Barcelona. Ariane Jewels will pursue any breach of these General Conditions, as well as any misuse of the website, by exercising all civil and criminal remedies available to it by law.
